Welcome to Mr. Black Studio. By using our services, subscribing to our monthly plans, or hiring us for a project, you agree to these Terms and Conditions. Please read them carefully.
1. Our Services Mr. Black Studio provides website design, Framer development, custom digital solutions, SEO, hosting management, and ongoing website maintenance. We work in three main phases for project delivery: Discover and Analysis: We study your brand and create a project roadmap. Design and Implement: We build and design your site. Deliver and Monitor: We launch the site and show you how it works.
2. Website Projects & Turnaround Times Client Content: You are responsible for providing images, logos, copy, and information needed to complete the website unless agreed otherwise. Deadlines: Delays in sending us required content or approving designs will delay the final launch of your site. Revisions: Design revisions must be requested within the active development phase before final sign-off. Major redesigns requested after approval may incur extra fees.
3. Monthly Plans & Subscriptions We offer three main monthly maintenance and growth plans: The Essential Plan (R2,499 / month): Covers hosting, domain management, basic security, 24/7 uptime monitoring, basic content updates, and monthly reports. The Growth Plan (R3,499 / month): Includes all Essential features plus SEO setup/improvements, speed optimization, performance tracking, and conversion updates. The Black Plan (R4,999 / month): Includes all Growth features plus full website management, design tweaks, priority support turnaround, continuous development, and strategic guidance.
Subscription Rules: Monthly plans are billed automatically every month in advance. Services under these plans continue as long as payments are up to date. If a payment fails, we reserve the right to pause your website hosting or maintenance services until payment is received.
4. Payments, Refunds, and Cancellation Project Payments: Custom project fees or deposits must be paid according to the invoice agreement before work starts or final files/access are handed over. Refunds: Because design and development involve custom labor and dedicated time, fees paid are non-refundable once work on a phase has commenced. Canceling Subscriptions: You may cancel your monthly plan (Essential, Growth, or Black) by giving us 30 days’ written notice before your next billing cycle.
5. Intellectual Property & Ownership Your Content: You keep full ownership of all materials, logos, text, and photos you provide to us. Final Deliverables: Once your project balance is paid in full, you own the rights to the final website design and code created for you. Studio Portfolio: We reserve the right to display your completed website and brand design in our portfolio, website showcases, and social media unless signed under an explicit Non-Disclosure Agreement (NDA).
6. Third-Party Tools & Hosting We build sites using third-party platforms such as Framer, Webflow, or domain registry providers. Mr. Black Studio is not liable for third-party service outages, platform policy changes, or hosting bugs caused directly by Framer or external server networks outside our direct control.
7. Warranties and Limitation of Liability We aim for 100% uptime, fast speed, and smooth user experience, but we cannot guarantee that your website will always be error-free or uninterrupted. Mr. Black Studio is not responsible for business losses, lost sales, or downtime damages caused by unexpected technical failures, hacking attacks, or delayed client approvals.
8. Termination of Service We reserve the right to terminate our services or stop working on a project immediately if: Invoices remain unpaid after due dates. The client engages in abusive, threatening, or illegal behavior toward our team.
9. Governing Law These Terms and Conditions are governed by and interpreted under the laws of the Republic of South Africa. Any legal disputes will be resolved within local South African courts.
